CONSIDERANDO

CONSIDERING

Que la existencia de Bifenilos Policlorados (BPCs) es un problema ambiental importante en nuestro país, ya que representan un riesgo potencial para el medio ambiente. Asimismo, el cumplimiento a convenios internacionales vinculantes como el Convenio de Estocolmo, requiere de programas e instrumentos que permitan llevar a cabo el manejo adecuado hasta la eliminación de los BPCs, conforme a los plazos establecidos en los distintos ordenamientos aplicables y en los lugares señalados.

That the existence of polychlorinated biphenyls (PCB’s) is an important environmental problem in our country, since it represents potential risk to the environment. Also, compliance with binding international agreements such as the Stockholm Convention requires programs and tools to carry out proper handling until the elimination of PCBs, according to the terms established in the various applicable regulations and in indicated locations.

Que con fecha 10 de diciembre de 2001, se publicó, en el Diario Oficial de la Federación, la NORMA Oficial Mexicana NOM-133-SEMARNAT-2000, Protección ambiental-Bifenilos policlorados (BPCs)- Especificaciones de manejo.

That on December 10 of 2001, the Official Mexican Standard NOM-133-SEMARNAT-2000, Environmental Protection – Polychlorinated Biphenyls (PCBs) Handling Specifications, was published in the Official Daily of the Federation.

Que el 5 de marzo de 2003, se publicó, en el Diario Oficial de la Federación, la modificación a la NOM-133-SEMARNAT-2000, a través de la cual únicamente se efectúa el cambio de la fecha límite de eliminación de equipos BPCs, equipos eléctricos BPCs y residuos peligrosos BPCs, almacenados antes de la publicación de la norma, indicada en la tabla 1 de la misma.

That on March 5 of 2003, the modification to NOM-133-SEMARNAT-2000, was published in the Official Daily of the Federation, through which only the deadline was affected for the elimination of PCBs equipment, PCBs electrical equipment, and PCBs hazardous waste was established, stored prior to the publication of the standard, established in table 1 of the same.

Que con fecha 20 de marzo de 2007 y derivado de la revisión quinquenal de la NOM-133-SEMARNAT-2000, se ratificó su contenido ante la Dirección General de Normas, adscrita a la Secretaría de Economía.

That on March 20 of 2007, and derived from the five year review of NOM-133-SEMARNAT-2000, its content was ratified before the General Direction of Standards under the Secretary of Economy.

Que la NOM-133-SEMARNAT-2000, definió las especificaciones de protección ambiental para el manejo de equipos, equipos eléctricos, equipos contaminados, líquidos, sólidos y residuos peligrosos que contengan o estén contaminados con bifenilos policlorados y los plazos para su eliminación, mediante su desincorporación, reclasificación y descontaminación, conforme a lo siguiente:

That NOM-133-SEMARNAT-2000, defined the environmental protection specifications for environmental protection for the handling of equipment, electrical equipment, contaminated equipment, liquids, hazardous solids and wastes that contain or are contaminated with polychlorinated biphenyls and the terms for their elimination through decommission, reclassification, and decontamination, according to the following:

• Inscribirse como empresa generadora (poseedora) de bifenilos policlorados, incluyendo el inventario de los mismos a más tardar tres meses después de la entrada en vigor de la norma (11 de marzo de 2002).

• Register as company which is a producer (holder) of PCBs, including inventory of the same no later than three months after the entry into force of the standard (March 11, 2002).

• Eliminar los equipos, equipos eléctricos y residuos BPCs que tuviera desincorporados y almacenados antes de la publicación de la norma referida dentro del año siguiente a la entrada en vigor de dicha norma (es decir, el 11 de diciembre de 2002).

• Remove PCBs equipment, electrical equipment and wastes that were decommission and stored before the publication of the referred to standard within the year following the entry into force of said standard (that is, December 11 of 2002).

• Eliminar los equipos, equipos eléctricos y residuos BPCs que tuviera en uso, a más tardar el 31 de diciembre de 2008, y

• Remove PCBs equipment, electrical equipment and wastes that were in use no later than December 31 of 2008, and

• Eliminar los residuos generados durante el periodo de desincorporación y equipos desincorporados dentro de los 9 meses siguientes a su desincorporación.

• Eliminate the wastes generated during the decommission period and decommissioned equipment within 9 months following decommission.

Una vez finalizados los plazos establecidos en la norma en mención, para la eliminación de materiales, equipo y residuos BPCs, se hicieron estudios como el denominado “Manejo y Destrucción Ambientalmente Adecuados de Bifenilos Policlorados en México” Undp 00059701, del Programa de las Naciones Unidas para el Desarrollo, el cual alertó sobre la problemática resultante de las actividades de mantenimiento a equipos BPCs, al concluir que existe contaminación cruzada, misma que extiende los alcances de la problemática.

Once the terms established in the aforementioned standard for the elimination of PCBs materials, equipment and waste have expired, studies such as the "Environmentally Sound Handling and Destruction of Polychlorinated Biphenyls in Mexico" Undp 00059701 were performed, which warned about the problems resulting from PCBs equipment maintenance activities, upon concluding that there is cross-contamination, which extends the scope of the problem.

Las primeras proyecciones realizadas por el Proyecto del PNUD, señalaban que se tenían que eliminar 28,939 toneladas de equipo BPCs en el país. Con la aplicación de la Norma se eliminaron sólo 18,587 toneladas en 9 años, por lo que se deben redoblar esfuerzos para poder cumplir con el compromiso de eliminación de BPCs al año 2028.

The first projections performed by the UNDP Project, established that 28.939 tons of PCBs equipment in the country had to be eliminated. With the application of the Standard only 18.587 tons were eliminated in 9 years, which is why efforts must be redoubled in order to meet the commitment to eliminate PCBs by the year 2028.

Que la modificación a la Norma Oficial Mexicana NOM-133-SEMARNAT-2000 se encuentra inscrita en el Programa Nacional de Normalización 2015.

That modification to Official Mexican Standard NOM-133-SEMARNAT-2000 is incorporated into the 2015 National Standardization Program.

Que por lo anterior se sometió a consideración del Comité Consultivo Nacional de Normalización de Medio Ambiente y Recursos Naturales, el Proyecto de Modificación a la Norma Oficial Mexicana mismo que fue aprobado, en su Segunda Sesión Extraordinaria, celebrada el 1o. de diciembre de 2014, para su publicación en el Diario Oficial de la Federación, de conformidad con el artículo 47 de la Ley Federal sobre Metrología y Normalización, a efecto de que los interesados en el tema, dentro de los sesenta días naturales, contados a partir de la fecha de su publicación en el Diario Oficial de la Federación, presentarán sus comentarios ante el Comité Consultivo Nacional de Normalización de Medio Ambiente y Recursos Naturales, sitio en Boulevard. Adolfo Ruiz Cortines No. 4209, 4o. Piso Ala “B”, Fraccionamiento Jardines en la Montaña, Delegación Tlalpan, Código Postal 14210, México Distrito Federal o en el correo electrónico: dgi@semarnat.gob.mx.

Due to the above, the Project of Modification to the Official Mexican Standard was submitted to the consideration of the National Consultative Committee of Standardization of Environment and Natural Resources, which was approved in its Second Special Session held on the 1^st of December of 2014, for its publication in the Official Daily of the Federation, in accordance with article 47 of the Federal Law on Metrology and Standardization, so  that within the sixty calendar days following its publication in the Official Daily of the Federation, the interested parties might submit their comments to the National Consultative Committee of Standardization of Environment and Natural Resources, located at 4209 Adolfo Ruiz Cortines Boulevard , 4^th Floor, “B” Wing, Jardines en la Montaña, Tlalpan, Postal Code 14210, Mexico Federal District or at the email: dgi@semarnat.gob.mx.

Que el proyecto señalado en el párrafo que antecede, se publicó en el Diario Oficial de la Federación, el 16 de diciembre de 2014 y, durante el plazo de sesenta días naturales, la Manifestación de Impacto Regulatorio a que se refiere el artículo 45 de la Ley Federal sobre Metrología y Normalización, estuvo a disposición del público para su consulta en el domicilio del Comité antes citado.

That the project stipulated in the above paragraph was published in the Official Daily of the Federation on December 16 of 2014 and, during a term of 60 days the Declaration of Regulatory Impact referred to in article 45 of the Federal Law on Metrology and Standardization was available to the public for its consultation in the aforementioned address of the Committee.

Que los comentarios recibidos en torno al proyecto de norma en cita, fueron analizados por el Comité Consultivo Nacional de Normalización de Medio Ambiente y Recursos Naturales, realizándose las modificaciones procedentes al instrumento normativo, de acuerdo a lo establecido en el artículo 33 del Reglamento de la Ley Federal sobre Metrología y Normalización.

That the comments received regarding the mentioned standard project, were analyzed by the National Consultative Committee of Standardization of Environment and Natural Resources, performing the appropriated modifications to the legal instrument, in accordance with that established in article 33 of the Regulation of the Federal Law on Metrology and Standardization.

Que las respuestas a los comentarios recibidos durante el periodo de consulta pública fueron publicadas el 7 de diciembre de 2015, en el Diario Oficial de la Federación, de conformidad con el artículo 47 fracción III de la Ley Federal sobre Metrología y Normalización.

That the responses to the comments received during the public consultation period were published December 7 of 2015, in the Official Daily of the Federation in accordance with article 47 section III of the Federal Law on Metrology and Standardization.

Que habiéndose cumplido el procedimiento establecido en la Ley Federal sobre Metrología y Normalización para la elaboración de normas oficiales mexicanas, el Comité Consultivo Nacional de Normalización de Medio Ambiente y Recursos Naturales aprobó la presente norma oficial mexicana como definitiva, en su cuarta sesión ordinaria, celebrada el 6 de noviembre de 2015.

That having complied with the procedure established in the Federal Law on Metrology and Standardization for the creation of Official Mexican Standards, the National Consultative Committee of Standardization of Environment and Natural Resources approved the present Official Mexican Standard as definitive, in its fourth ordinary session, celebrated November 6 of 2015.

Que de conformidad con lo establecido en el artículo 28 fracción II, inciso d) del Reglamento de la Ley Federal sobre Metrología y Normalización, el año de la clave de esta norma oficial mexicana, cambia a 2015, debido a que el instrumento regulatorio se presentó ante el Comité Consultivo Nacional de Normalización de Medio Ambiente y Recursos Naturales para aprobación en dicho año.

That according to that established in article 28, section II, sub-section d) of the Federal Law on Metrology and Standardization, the year of the code of this Official Mexican Standard, changed to 2015, since the legal instrument was presented to the National Consultative Committee of Standardization of Environment and Natural Resources for its approval in said year.

1. Objetivo

1. Objective

Esta Norma Oficial Mexicana establece las especificaciones para el manejo y eliminación ambientalmente adecuados de los residuos peligrosos que contengan o estén contaminados con Bifenilos Policlorados, a partir de que son desechados, así como para el manejo y tratamiento de equipos BPCs.

This Official Mexican Standard establishes the specifications for the adequate environmentally handling and elimination of hazardous wastes that contain or are contaminated with Polychlorinated Biphenyls, from the moment of their creation as wastes, as well as for the handling and treatment of PCBs equipment.

2. Campo de aplicación

2. Field of application

Esta Norma Oficial Mexicana es de observancia obligatoria para todas las personas físicas y morales que posean equipos BPCs o generen residuos peligrosos BPCs, así como para aquellos que presten servicios de manejo de los mismos.

This Official Mexican Standard is designated as mandatory observance for all persons and companies which possess PCBs equipment or generate PCBs as hazardous wastes, as well as for those service providers of the same.
