GHS COMPLIANT SDS – INSTRUCTIONS FOR SUPPLIERS

In October of 2018, the Health and Safety Standard “NOM-018-STPS-2015, HARMONIZED SYSTEM FOR THE IDENTIFICATION AND COMMUNICATION OF HAZARDS AND RISKS FROM HAZARDOUS CHEMICAL SUBSTANCES IN THE WORKPLACE,” will take effect. The lapse between the publication in the Official Daily of the Federation and its taking effect is to allow companies time to adapt their hazardous communication systems, labels, signs, and SDS to the GHS. The GHS stands for the Globally Harmonized System of Classification and Labelling of Chemicals. GHS defines and classifies the hazards of chemical products.

Companies that import or export, transport, store and use chemicals in their production and generate wastes must adapt their procedures to GHS.
 

  
If your foreign suppliers are providing GHS compliant SDS in Spanish, they may still not be compliant with the new standard. The new standard requires the maximum permissible limits of exposure from the Mexican standard NOM-010-STPS-2014 to be on the SDS

I have been reviewing SDS sent to me by different clients and I am finding that many if not most do not comply with the Mexican standard, so I have created a guide using the instructions for the preparation of an SDS from the Standard. I recommend that you download these instructions to review the SDS that you are being provided by your suppliers; I am also giving permission to share these instructions with your providers.

The Federal Law on Metrology and Standardization. Published in the DOF on July 1, 1992 – last reform published in the DOF December 18, 2015.
Many Mexicanlaws clients having been asking for this Law. It is the law that regulates the system of measurements used in Mexico and sets the rules and procedure for preparing NOMs (Official Mexican Standards) and NMXs (Mexican Standards).  
Some of you may be familiar with the process for the creation of standards and the different stages in the creation of standards including input from the public. I usually review and make comments and suggestions when new projects are published for the 60 day comment period. 3 of my suggestions were accepted and incorporated into the new NOM-018-STPS-2015. If anyone is interested in being part of this comment phase and submitting a comment, I can assist you with the formulation of your comment.
Federal Law of Civil Protection. Originally published in the DOF June 06, 2012 – reformed June 03, 2014, latest reform April 07, 2017.
This is an important piece of legislation. All companies classified as “High Risk” for fire, must complete a Civil Protection certification or certify their health and safety program through the Federal STPS “Auto Gestion” program.

NOM-014-CONAGUA-2003, Requirements for the artificial recharge of aquifers with treated wastewater.

NOM-015-CONAGUA-2007, Artificial infiltration of water to aquifers. Characteristics and specifications of the works and the water. Published in the Official Daily of the Federation on August 18, 2009.

LAW OF FOREIGN INVESTMENT reforms were published in the DOF March 29, 2017 and the new version is available.
 

DUAL NATIONALITY

 
You may already be a Mexican citizen. Do you have one parent born in Mexico?

If you have one parent born in Mexico, according to the Mexican Constitution, article 30, you are a Mexican national by birth.
 

“Article 30. Mexican nationality is acquired by birth or naturalization.
A) The following are Mexicans by birth:
I. Those that are born in territory of the Republic, whatever the nationality of their parents.
II. Those that are born outside of Mexico, children of Mexican parents born in National Territory, of a Mexican father born in National Territory or a Mexican mother born in National Territory.

You can verify your Mexican nationality without affecting your US citizenship and have a Mexican passport, Voter I.D., etc. This is not difficult and you can be issued a Certificate of Nationality (Certificado de Nacionalidad Mexicana) in one day at a Mexican Consulate in the US.


It is easier to do this at a Mexican consulate, but you can also do this in Mexico at the Secretaría de Relaciones Exteriores.

 

This is how you do it.
▪ Make an appointment at a Mexican Consulate in the US on the Internet or by telephone.
▪ Fill out the DNN form. Download the form at: www.mexicanlaws.com/dnn1.pdf
▪ Attach a certified copy of your birth certificate issued by a Mexican consulate when your parents registered your birth or a certified copy of your birth registered in Mexico at a Civil Registry. If your parents did not take your US birth certificate to the Mexican Consulate to register your birth within the first year of your birth or register your birth with your US certificate in Mexico at the Civil Registry, you must attach the following to your application.
▪ Certified copy of the Marriage license (Acta de Matrimonio) if the parents married in Mexico. If they married in the US, and did not register their marriage at the Consulate or at the Civil Registry in Mexico, then attach the original marriage license from the US with Apostille.
▪ Certified copy of the birth certificate of the Mexican father or mother issued by the Mexican civil registry.
▪ Present the original and a copy of your current US official identification (passport);
▪ Two color photos passport size (4.5 cm x 3.5 cm) with a white background, face forward, without glasses, hair uncovered, within the last 30 days.
▪ Receipt for payment – (you will be able to pay with cash or a credit card at the Consulate and the cost is: $265.00 pesos)

 

If you have all the above documents in order, you will be issued a Certificate of Nationality on the same day.
